The decision of the Constitutional Court of Ukraine has a purely political motive

The Grand Chamber of the Constitutional Court of Ukraine in a closed session abolished criminal liability for false declarations and declared unconstitutional certain provisions of the Law "On Prevention of Corruption".

 

In fact, the National Agency for Corruption Prevention has lost its authority:

  • to check electronic declarations;

  • to monitor lifestyle;

  • to bring officials to justice for corruption offenses and exercise a number of other powers.

 

The Anti-Corruption Headquarters considers that the court decision nullifies the work of the state of the last 7 years in the field of preventing and combating corruption and implementing anti-corruption reforms in general.

 

It should be noted that the NACP found lies in the declarations of two judges of the Constitutional Court - Iryna Zavhorodna and Serhiy Holovaty and drew up administrative protocols on non-submission of notifications of significant changes in property status by CCU judges Volodymyr Moysyk and Ihor Slidenko. Thus, 4 judges of the Constitutional Court had a conflict of interest when deciding on the powers of the NAPC.

 

Closing access to the public registry of electronic declarations will worsen the work with open data. Because most of the innovative tools, including the "Hidden Interests" of the Anti-Corruption Headquarters, operate on the basis of declarations registry.

 

The Anti-Corruption Headquarters calls on international partners to prevent a retreat in the implementation of anti-corruption reform in Ukraine. We call on you to make every possible effort to restore the electronic declaration system, ensure the transparency of assets and property of officials. We urge you to inform the President of Ukraine and the Verkhovna Rada of Ukraine of the risks posed by this decision to Ukraine’s international obligations and to disseminate this statement as much as possible in your communication channels.

 

Anti-corruption reform in Ukraine has become possible thanks to the support of our international partners. Therefore, only by joint efforts will we be able to prevent corruption from nullifying the anti-corruption reform.
