Civil society’s expectations of The National Agency on Corruption Prevention (NACP)

On June 4th, in the form of online discussion, the representatives of NACP and NGOs discussed the outcome of the 4-months performance of NACP’s new executive team. During the discussion, the representatives of civil society evaluated NACP’s accomplishments, highlighting both positive moments and the ones that, in our opinion, require further attention from the executive team’s side.

 

In summary, the participants of the discussion created a common list where they express their recommendations and notices to increase NACP’s performance effectiveness.

1. Develop an Anticorruption strategy project and pass it to the Verkhovna Rada over the three months.

2. Define the indicators of NACP’s effectiveness.

3. Provide information to the public regarding the National Agency’s decisions and the outcomes of its performance on NACP’s website. Besides, we consider it crucial to announce the results of judicial review of protocols on administrative offenses composed by officials of the National agency; publish normative legal acts to enable appropriate public consideration and consultation.

4. Implement a concept of performance of Whistleblower Protection and Processing of Reports on Corruption Office in the following directions:

4.1. Training: for the employees who monitor the internal messages within the institution to detect corruption risks; for the commissioners for the prevention and detection of corruption; subjects of power authority.

4.2. Development of educational resources (Manual for whistleblowers; Methodical manual regarding carrying out training for whistleblowers; Methodical recommendations for the authorized persons regarding whistleblowers’ protection; Writing a notice to the provision of the Ukrainian law “About corruption prevention” about whistleblowers);

4.3. Educational measures (Social advertisements to form a culture of respect for whistleblowers; Organization of public events, including round tables for discussing enforceable practice regarding whistleblowers).

5. Begin effective realization of the anti-corruption expertise of bills and by-laws:

5.1. Develop a new methodology of carrying out expertise;

5.2. Begin carrying out anti-corruption expertise of the bill before the second reading in the most corrupt spheres.

5.3. Develop a project of changes to Regulations of the Verkhovna Rada and Regulations of the Cabinet of Ministers of Ukraine, aiming to create an effective mechanism of blocking projects of acts in case of detecting corruption risks;

5.4. Publish texts of conclusions and quarterly reports about the execution of anti-corruption expertise in accessible form  on NACP’s website.

6. Financial reporting of political parties:

6.1. Strengthen the level of communication with parties and organize an informative campaign with clarifications of working with an electronic register of the financial statements. Additionally, provide step-by-step instructions about filling in reports with a notice of the most common mistakes during the process.

6.2. Introduce monitoring of parties’ performance, which will enable comparing real- scale activities and expenses with the ones represented in the parties’ financial reports.

6.3. Improve the performance of the detection of “dummy” donors, in particular through the analysis of the financial abilities of natural persons and legal entities  to transfer significant contributions to the parties.

6.4. Establish analytical work of parties’ financial statements, which allows spotting phenomena and trends, forming high-quality and reasonable suggestions in laws and by-laws. Moreover, the presence of such analytics increases the quality of public informing, in particular about the ways of spending government’s funding of statutory functions of parties.

7. Some of the provisions of the procedure for the automated distribution of responsibilities for inspections approved by the National Agency have to be specific and detailed, avoiding manipulations and risks of independent intervention into its procedures.

8. Conduct a complex evaluation of IT-infrastructure.
